The information contained within this agreement supersedes any pre-existing verbal or written employee information that may or may not have been exchanged with a customer, vendor, client, or other. Billiard Factory reserves all rights to update this information without notice and it is the customers sole obligation/responsibility to check these terms and conditions before placing any order or obtaining any information from Billiard Factory. By placing an order with Billiard Factory, the customer understands and agrees to all terms and conditions unless otherwise agreed upon in writing with Billiard Factory.
Billiard Factory's goal is to advertise correct pricing but understands mistakes can be made. Billiard Factory reserves the right to change/alter pricing at will without notice. If an order is placed with incorrect pricing, Billiard Factory reserves the right to cancel the order. This can include, but not limited to, products, gift cards, custom furniture, and other items including labor and shipping. If you have a question regarding a price, Billiard Factory advises contacting a support specialist before placing your order.

Once a custom product is sold, the customer has 7 days to cancel the order for a full refund. Once the 7 days has passed, the customer has the option to get a partial refund equaling 50% of the total ticket. After 30 days the customer can no longer cancel the order. Due to the nature of custom products, sometimes we are unable to give you an accurate timeframe of production, or production may go past the stated estimated time or arrival. By purchasing a custom product from Billiard Factory, you agree and understand that Billiard Factory does not guarantee any timeframe stated in written or verbal format and custom/special orders cannot be cancelled/altered in any way due to extended unforeseen wait times.
Our goal is your complete satisfaction. Billiard Factory's professional sales and design consultants will make certain your selections are right for you. Orders of in-stock merchandise can be canceled anytime up to 48 hours prior to delivery for local market customers for a full refund. If an order is canceled after that time, store credit will be issued. Sales cannot be canceled, returned or exchanged after merchandise has been delivered or picked up.
"AS-IS" and Floor Sample clearance merchandise being purchased off our floors and cannot be canceled, returned or exchanged. They are a final sale and only qualify for the manufacturer's warranty if installed by Billiard Factory. These items must be picked up or delivered within 15 days of purchase. If delivery does not take place within the 15-day time frame, a 50% restocking fee will be applied to the order and the customer will be refunded the remaining 50%.
"Discontinued", "Close-Out" or "Clearance" (from stock) merchandise is coming from our warehouse inventory. These items cannot be canceled, returned or exchanged. They are a final sale. These items must be picked up or delivered within 14 days of purchase.
Finishes are not guaranteed to be a perfect match to website images or in-store samples due to various applications of materials and selection. There will be variation in color, texture and shading. Manufacturers of upholstery fabrics do not guarantee their material for colorfastness, fading, wearing quality, durability or adverse reaction to environmental conditions or dye lot variations.
Generally, we'll charge your payment method for an item at the time of purchase or confirm its availability in store before running a payment. However, we will preauthorize your order amount (including for pre-orders) with your payment method at the time you place the order, which may influence your available credit line.
Our order confirmation to you does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. We may impose these limits on a per-person, per-household, per-order, or any other basis. If we reject, limit, or otherwise modify your order, we will attempt to notify you using the email address you provide to us. If we cancel an order or part of an order that we've already charged you for, we'll refund you the full amount of the canceled portion of the order.

We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.

You may return the eligible unused item(s) in its original packaging and in the condition it was received within 14 days of delivery or pick up. The customer is responsible for any fees that are related to shipping the merchandise back to Billiard Factory unless the return is a result of our error. Billiard Factory highly recommends that you make your return in person to one of our stores or ship your return to The Billiard Factory, 2013 S Persimmon St #100, Tomball Texas 77375 using UPS, FedEx, USPS or a similar service that offer the ability to track your shipment. We are not able to offer refunds on merchandise lost in transit being shipped back to us.
All items that are delivered to you via UPS, FedEx, USPS or similar service should be examined upon arrival for damage and note with the carrier before taking possession any visible damage to the product packaging. If you receive a shipment damaged, please refuse delivery of said shipment and have the shipping company return it. If you receive an item damaged and do not refuse it, you have accepted the condition and the item cannot be returned.
The original receipt, gift receipt, and packing slip (if applicable) are required for all returns and exchanges; and a valid photo I.D. may also be required.
Items that are custom (personalized by you or your representative), special order (not in stock at the time of your purchase), electronic, or has been assembled or installed are all NOT eligible for return (unless the product has been damaged by our installation team). Additional items not eligible for return are; labor, delivery and/or installation services; consumable goods such as chalk or shuffleboard powder; any product purchased used, as is, or within a clearance sale; items that are damaged, abused or appear to be misused; Items that are missing parts or accessories; furniture that has been assembled; any and all electronic items; anything after 14 days of delivery or pick up; anything that has visible signs of use; anything not in its original packaging.
A restocking fee of 25% may apply to any return eligible product purchased in our stores or online.
Gift card & gift certificate purchases are final (no refunds will be given).
If you are returning an eligible item that included additional items such as a free gift promotion, then you must return all the items received as a free gift to receive the full credit. If you do not return all of the items included with the free gift then the cost of those items will be deducted from the amount refunded. The free gift item(s) cannot be returned by themselves for any type of credit or refund.
If you return an eligible item that was part of a larger package or bundle of products and received a discount for purchasing the item together, the amount of refund will be discounted in proportion to the value of the product in relation to the total value of the package as a whole.
Billiard Factory may issue refunds in the form of a credit to the original credit card, check or in-store credit.
Eligible items that are returned that were originally purchased with a check or cash will be issued either an in-store credit, or a check for the refund amount will be mailed to you from our corporate offices. Purchases that were made by check will be refunded once the customer's check has cleared our bank. Cash and check returns that require a check from our corporate office may take up to 14 business days to process once the item is inspected and return eligibility is confirmed.
Refunds issued for returned merchandise that was purchased with a credit card will have the amount of the refund credited back to the card that was used for the original purchase. If the original card is no longer available, an in-store credit can be issued.
Billiard Factory reserves the right to refuse a refund without a receipt or for any item deemed not eligible for return and to make changes to this policy without notice.

All New merchandise comes with the Original Manufacturer Limited Parts Warranty with every purchase. The warranty period, coverage, and exclusions are different by brand and component. Please contact your sales representative to inquire about Original Manufacturer warranty specifics and exclusions.
